These Terms and Conditions ("Terms") govern your use of SiteSpeaks ("Service") operated by SiteSpeaks ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Service Description

SiteSpeaks is an AI-powered chatbot service that:

Processes RSS feeds to create intelligent chatbots
Provides embeddable chatbot widgets for websites
Offers natural language search and content understanding
Integrates with Microsoft NLWeb technology
Stores RSS items in our database for incremental processing
Supports multiple payment gateways (Razorpay and Stripe)

2. Account Registration and Responsibilities

2.1 Account Creation

You must provide accurate and complete information when creating an account
We collect your email, name, password, phone number, preferred payment gateway, and country
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized use of your account
You must be at least 18 years old to use our Service

2.2 Account Responsibilities

You are responsible for all activities under your account
You must not share your account credentials with others
You must not use the Service for any illegal or unauthorized purpose
You must provide valid RSS feed URLs that you own or have rights to

3. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit harmful, offensive, or inappropriate content
Attempt to gain unauthorized access to our systems
Interfere with the Service or other users
Use the Service for spam or unsolicited communications
Reverse engineer or attempt to extract our source code
Provide invalid or non-functional RSS feed URLs

4. RSS Feed and Content Requirements

4.1 RSS Feed Ownership

You must own or have rights to the RSS feeds you provide
You must ensure your RSS feeds comply with applicable laws
You are responsible for the accuracy and legality of your content
RSS feeds must be valid XML format and accessible via HTTP/HTTPS

4.2 Content Standards

Content must not be illegal, harmful, or offensive
Content must not infringe on third-party rights
Content must be accurate and not misleading
Content must comply with our Acceptable Use Policy

4.3 RSS Processing

We store RSS items in our database for processing and optimization
Only new RSS items are sent to AI training to reduce costs
We maintain item history for incremental processing
RSS items include titles, descriptions, links, and publication dates

5. Service Plans and Pricing

5.1 Free Plan

Includes 500 interactions per month
Manual RSS feed synchronization
Basic chatbot functionality
Standard support
1 website and 1 RSS feed

5.2 Paid Plans

Higher interaction limits
Automatic RSS feed synchronization
Custom branding options
Priority support
Advanced analytics
Multiple websites and RSS feeds

5.3 Payment Terms

Paid plans are billed monthly or annually
Payments are processed through Razorpay (UPI, NetBanking, Cards, Wallet, EMI) or Stripe (Cards, Apple Pay, Google Pay, Bank Transfer)
Prices are subject to change with 30 days notice
Refunds are handled according to our refund policy
Upgrades charge full amount immediately with no proration
Downgrades are scheduled for end of billing cycle

6. Service Availability and Limitations

6.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service
We may perform maintenance that temporarily affects service
We are not liable for service interruptions
RSS feed processing may be delayed during high traffic periods

6.2 Service Limitations

Usage is subject to fair use policies
We may throttle or limit excessive usage
Service features may vary by plan
RSS feeds must be accessible and in valid XML format
Maximum limits apply to websites, feeds, and interactions per plan

7. Intellectual Property

7.1 Our Rights

SiteSpeaks and its technology are our intellectual property
You may not copy, modify, or distribute our software
Our trademarks and branding are protected
Microsoft NLWeb integration is proprietary to our service

7.2 Your Rights

You retain ownership of your content and RSS feeds
You grant us license to process your RSS feeds for the Service
You may remove your content at any time
You retain rights to your website content and chatbot responses

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms.

9. Termination

9.1 Termination by You

You may cancel your account at any time
Cancellation takes effect at the end of your billing period
No refunds for partial months (except billing errors within 7 days)
You can downgrade to free plan instead of cancelling

9.2 Termination by Us

We may terminate your account for Terms violations
We may terminate for non-payment
We will provide reasonable notice when possible
We may terminate for providing invalid RSS feeds

9.3 Effect of Termination

Your access to the Service will end
We will delete your data within 30 days
You must remove our chatbot from your websites
RSS processing will stop immediately

10. Disclaimers and Limitations

10.1 Service Disclaimers

The Service is provided "as is" without warranties
We do not guarantee accuracy of AI responses
We are not responsible for third-party content
RSS feed availability depends on external sources
AI processing may have delays or limitations

10.2 Limitation of Liability

Our liability is limited to the amount you paid us
We are not liable for indirect or consequential damages
Some jurisdictions do not allow liability limitations
We are not liable for RSS feed downtime or content changes

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

Your use of the Service
Your violation of these Terms
Your content or RSS feeds
Your violation of third-party rights
Your website content or chatbot responses

12. Governing Law and Disputes

These Terms are governed by the laws of India
Disputes will be resolved through arbitration
Arbitration will be conducted in Hathras, UP, India

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending you an email notification
Updating the "Last updated" date

Continued use of the Service after changes constitutes acceptance of the new Terms.
